While Farren Safaris has made a diligent effort to obtain reliable information concerning the guides, tour operators and outfitters described herein it does not guarantee that the information is accurate Farren Safaris (hereafter "The Company" ) acts as a booking agent for hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services abroad. Each of these companies is an independent business with its own management and is not subject to the control of the Company. Any agreement resulting from the acceptance of an order is deemed to be an agreement between the relevant business partner and the Customer.  


The Company does not own or operate any entity which will provide goods or services for your trip including, but not limited to, lodging facilities, airline or other transportation companies, guides or guide services, local ground or safari operators, or food service providers. All bookings like those described above are accepted by the Company as agent for independent overseas ground operators. The transportation, accommodations and other services provided by the ground operators are offered subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers. ​


Because the Company does not have the right to control the operations of the independent operators and their suppliers, IT CANNOT BE LIABLE FOR ANY PERSONAL INJURY< PROPERTY DAMAGE OR ECONOMIC LOSSES which may arise out of these services.  

Farren Safaris, its employees, shareholders, agents, and assigns is not liable for any negligent or willful act or failure to act of any such person, or of any other third party.


Our staff of consultants spend many long hours and log thousands of miles each year in order to offer our clients what we believe to be the world's finest tour operators, guides and outfitters. The Company can not, however, guarantee the quality of such operators, guides and outfitters. Any purchase of goods or services which the Customer makes while on the trip are solely at Customer's risk, including, without limitation, such problems as defects, failure to ship or damage to goods while in shipment, whether or not the purchase was made from a vendor recommended by a guide, other person rendering trip services or any third party. The Company make no guarantee as to the success, quality or quantity of fish or game that may result.  


Changes in itinerary may be made at the discretion of The Company or your local ground operator. Customer shall be responsible for the cost of accommodations and associated transportation caused by bad weather, flight schedules, overbooking or cancellations or other events beyond the control of the Company. In case of any appreciable variation in its cost, the Company reserves the right to adjust its rates.

 
AIR TRANSPORTATION If, for any reason beyond the control of Company, scheduled flights or air fares are changed, any increase in air fare will be collected from the Customer, and any decrease in fare will be refunded. The airline tickets issued by the airlines concerned, when issued, shall constitute the sole contract between these airlines and the Customer and/or tour members of any of these tours.  


PAYMENT SCHEDULE A deposit of up to 20% is required to confirm a booking, depending on the program selected. The final payment is due days before your departure date by check or credit card. If Customer's reservation is made within 60 days of departure, the entire cost of the trip must be paid on confirmation by wire transfer, certified or cashier's check only. If full payment is not received 90 days prior to departure, the Company reserves the right to cancel all arrangements without refund of any deposits received. A non-refundable deposit of per person is required on air reservations. Airfares are not guaranteed until paid in full and ticketed.


CANCELLATION
If the Customer cancels his/her trip, the deposit and all payment will be refunded, less a cancellation fee. If written notice of cancellation is received by the Company in hand more than 120 days prior to departure, the cancellation fee per person per trip is $250.00 or 5% of trip cost, whichever is greater; 89-75 days, $1,000.00 or 20% of the trip cost, whichever is greater; 75-45 days, 50% of trip cost; 44-31 days, 80% of trip cost; within 30 days 100% of trip cost. Trip "no-shows" will receive no refund. No partial refunds or credits will be given for unused services. Trip cancellation and interruption insurance are recommended.

The Company and local operators of tours and/or supplies of services and other cooperating agencies reserve the right to remove anyone from an adventure without refund who acts in a manner which is unsafe for him/herself or inconsiderate or unsafe to fellow travelers, and/or who ignores the requests of his or her guide(s) to act in a safe and considerate manner.

NO REFUNDS
No refunds are given for lost travel time or substitution of facilities; for itineraries amended after departrue; for circumstances arising beyond the Company's control which necessitate alternative arrangements; if Customer does not appear for any accommodation, service, sightseeing or trip segment without notifying the Company; or if Customer leaves the adventuresafter it has begun, or misses any schedule activities,meals or accommodations.

RISKS The Company draw's Customer's attention to the fact that there are certain inherent risks involved in participating in the type of trips booked by the Company. The Company will require Customer to sign a Release to acknowledge this warning and also to release and hold harmless the Company from any damages that may result. It is Customer's sole responsibility to seek all appropriate medical advice prior to departure as to whether or not Customer is fit enough to undertake the trip booked. The Company shall not be liable for illness, injury or death sustained which is not due to the gross negligence of the Company, it's officers, employees or authorized representatives whomsoever. Without limitation, the Company is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from but not limited to, acts of God or force majeure, acts of war or civil unrest, insurrection of revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking of accommodations, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, attacks or other actions of wild or domestic animals, disease, illness, epidemic, sanitation problems, lack of medical care and/or access to same, or for any other cause beyond the direct control of The Company.  

FORCE MAJEURE "Force Majeure" means, in relation to the Company, any circumstances beyond the reasonable control of the Company including, but without limitation, acts of God, explosion, flood, tempest, fire or accident, war or threat of war, terrorism, sabotage, insurrection, civil disturbance or requisition, sickness, quarantine, government intervention, weather conditions or other unexpected occurrences.
The Company shall not be deemed to be in breach of these terms and conditions or otherwise be liable to Customer, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. If the Company is affected by Force Majeure it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by the Company to Customer as a result of the non-performance of any of the Company's obligations hereunder shall remain in its sole and absolute discretion although the Company shall use its reasonable endeavors to reimburse Customer where possible. However, the Company shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to the Company of the Force Majeure. Regarding civil unrest, once the Company has investigated the prevailing situation as it deems fit, it shall remain in the Company's sole and absolute discretion whether to proceed with the trip. Customer may in such circumstances cancel the trip. However, if , after having made all reasonable and proper inquiries, the Company is of the opinion that the trip may proceed, no refund will be payable to Customer and the cancellation provisions detailed above shall apply.  

INSURANCE
The Company strongly recommends that Customer obtain the following types of insurance which are commercially available:
Accidental death and disability, Emergency medical evacuation, Trip cancellation, Major Medical and Loss of personal effects.

 

TRAVEL DOCUMENTS AND VACCINATIONS
It is Customer's responsibility to ensure that passports, visas, travel permits, health certificates, inoculations, international driving license, or other documentation required for the trip are obtained and are in order. It is Customer's responsibility to pay any additional cost incurred as a result of any failure by Customer to comply with such requirements.

GOVERNING LAW; DISPUTES This Agreement shall be deemed to have been made and entered into in the State of Maine, and all rights and obligations of the parties hereto shall be governed by and construed in accordance with the laws thereof. Customer hereby consents to and submits the the jurisdiction of the federal and state courts of the State of Maine in the judicial district encompassing Bangor, Maine, and further waive the right to commence any action against Company except in said courts.

ENTIRE AGREEMENT These terms and conditions govern the relationship between the Company and the Customer, to the total exclusion of any other terms and conditions. No alteration to the terms and conditions may be made by any of the Company's employees, authorized representatives or agents, unless in writing by an authorized officer of the Company.
